TERMS AND CONDITIONS AGREEMENT

This Agreement governing the terms and conditions of your use of Shiny Bins service is between you (“you” or “Customer”), as an authorized user of such services, and Shiny Bins (The Service).

This Agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Shiny Bins (collectively, the “Agreement”), constitutes the entire agreement between Shiny Bins and you regarding the Shiny Bins cleaning service. By using the Service, you confirm your acceptance of and agree to be bound by this Agreement.

SERVICE

Shiny Bins offers the trash can cleaning Service at its website https://www.getshinybins.com The Service is a trash bin cleaning service that initiates a recurring subscription by selecting any of the recurring service plans. This subscription renews automatically unless canceled prior to your anniversary date and must be in writing and delivered by email to Support@getshinybins.com or by post mail PO BOX 3554 Lawrence, KS 66046

CUSTOMER RESPONSIBILITIES

Communication from Shiny Bins provide email and/or SMS text messages for notifications regarding your service; please ensure that Support@getshinybins.com is whitelisted to ensure that Shiny Bins communication is not sent to your junk email folder.

Day of Service The trash bins should be at the curbside by 7:00 a.m. If this is not possible they should be visible from the street, and reasonably accessible. Our curbside service hours are provided between 7 a.m. to 9 p.m.

–  Cans must be empty to be serviced.  (We understand waste haulers sometimes can be late and we will attempt to service again later that day or may reschedule.) At Shiny Bins’ discretion, we may bag the contents, clean the can, replaced bagged contents and leave out for later waste hauler pick up). However, if they are taken in early or forgot to be put out, you will be charged for service.  If they are not out, we still have to  spend the time and fuel to arrive to provide the service.

–  Cans must be left out by the curb or accessible in the front of the house until we have cleaned them.

–  Cans will be serviced if left by the curb or in front of the house.   Cans must be plainly visible from the road.  We will NOT retrieve cans from inside a garage even if visible from the road.

* Shiny Bins will roll them back to your garage (up to 75 feet) when we are finished cleaning them.

* If you sign up for a 3 can cleaning and a lesser number is  available to clean, you will still be charged for the number of cans you signed up to have cleaned.

* No rotating cans on cleaning cycles. i.e. If trash and recycle are selected per your subscription, substituting a yard waste can instead of the recycle is not permitted.  This is why the cans are stickered.

Bins may have up remnants left over from collection of garbage. However, we reserve the right to refuse service if  has any of the following:

  1. More than 2 bags of garbage or any bag that weighs over 25 lbs.
  2. Loose, unbagged, trash, yard clippings, diapers or animal waste.
  3. Hazardous waste including chemicals, paint, glue, or other adhesives.
  4. Building materials like plaster, stucco, or concrete.

RESCHEDULING SERVICE:

If your bins can not be serviced on the scheduled day, please notify us before 7:00 a.m. the day of service by your portal or phone, and we will reschedule your cleaning for the following month. If you do not notify us, we will make an attempt, and if we’re unable to clean, you’ll be notified. There are no refunds after 7:00 a.m. on the day of cleaning service.

Rescheduling Fee for non-recurring service plans. If your bins cannot not be serviced on the scheduled day, please notify us before 7:00 a.m. the day of service, and we will reschedule your cleaning for the following month. If you do not notify us, and Shiny Bins dispatches our truck to your home, and can not provide service due to circumstances beyond our control, you will be notified by email why we could not provide service. Due to the cost associated with sending our employee, and vehicle to your home no refund can be provided.

CANCELATION OF SERVICE:

Bin Cleaning subscriptions will continue indefinitely. Cancelations must be made in writing or by mail delivered by email to Support@getshinybins.com or by post mail PO Box 3554 Lawrence, KS 66046. Cancellation notifications must be received prior to 7:00 a.m. on the day of service. There are no refunds after 7:00 a.m. on the day of service.

SHINY BINS’ RESPONSIBILITIES

If Shiny Bins fails to provide its service on the scheduled day of service for a reason other than the customer failing to meet his/her responsibilities in the paragraphs above, Shiny Bins will compensate the Customer by one of the following methods at its sole discretion.

  1. Arranging for the service to be performed on the next possible business day.
  2. Crediting the customer for the missed service.

MODIFICATIONS TO CUSTOMER AGREEMENT

Shiny Bins may amend this Agreement at any time by (a) posting a revised Customer Agreement at https://www.getshinybins.com and/or (b) mailing or sending information regarding the amendment to the email address provided to Shiny Bins by you.

We welcome all inquiries, questions and comments regarding any changes made to the agreement from our clients. Our goal is to always serve our clients to the best of our ability. Any changes to the agreement would be solely made for the betterment of the service program.

MODIFICATIONS TO SERVICE

Shiny Bins reserves the right to modify our delivery of service for the betterment of our clients and the overall success of the service program.

CHARGES

You agree to pay all charges for your use of the service at the prices in effect for your area of residence at the time of sign-up. All charges will be exclusive of value added sales or other taxes, except as required by law. Shiny Bins reserves the right to change prices or institute new charges for access to or use of the service. Any changes in pricing will be communicated to you by telephone, mail or email. It is your right to continue the service after your term or to discontinue the service at that time. Continued use of the services or non-termination of your Shiny Bins account after changes are communicated to you by telephone, SMS text message, mail or email correspondence constitutes your acceptance of the prices as modified by the posted changes. Payment for your Shiny Bins service is due in accordance with your cycle of payment and must be made by the credit card designated by you. Charges will be billed based upon your agreed payment schedule for the service that you have selected. If payment by credit card to Shiny Bins is not honored or fulfilled by the issuer of your credit or debit card (or its agent or affiliate), you agree to pay all amounts due upon demand by Shiny Bins. Each time you use the service you agree, and reaffirm that Shiny Bins is authorized to charge your designated card. Your card issuer’s agreement governs your use of your designated card in connection with Shiny Bins, and you must refer to that agreement with respect to your rights and liabilities as a cardholder. If you subscribed for the services pursuant to a special offer granting a pre-paid discount for a fixed number of months, your pre-paid fees are payable in advance and are non-refundable except for a proven relocation. You must promptly notify Shiny Bins of changes to: (a) the account number or expiration date of your designated credit or debit card; (b) your billing address (for the designated credit or debit card); and promptly notify Shiny Bins if your card is canceled (e.g., for loss or theft). Your service is a recurring charge, based upon your service schedule to the authorized credit card. You may opt out of future recurring charges at any time, as long as notice is received before the next billing date of your most recent sign-up by canceling via email at: Support@getshinybins.com Note: If you cancel a recurring service within 30 days after the first cleaning, you authorize Shiny Bins to charge the credit card on file for the difference between the recurring service price selected and the published Yearly service price. The minimum yearly cleaning plan fee for new customers is currently $50.00. Example; If you order monthly service for one bin, your first monthly cleaning is $24.00. If you cancel after the first cleaning, you authorize Shiny Bins to charge the card on file $26.00 (the difference between $24.00 initial payment, and the $50.00 one time cleaning rate). Shiny Bins reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges or if your card issuer (or its agent or affiliate) seeks return of payments previously made to Shiny Bins when Shiny Bins believes you are liable for the charges. Such rights are in addition to, and not in lieu of, any other legal rights or remedies available to Shiny Bins.

COMMUNICATION

By submitting this form a sign up form and signing up for texts, you consent to receive marketing text messages (e.g. promos, cart reminders) from Shiny Bins at the number provided, including messages sent by autodialer. Consent is not a condition of purchase. We do not share customer data with third parties for marketing purposes.  We do not share mobile opt-in information with anyone. Msg & data rates may apply. Msg frequency varies. Unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available).

MISCELLANEOUS

The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights. If any part, term or provision of this Agreement is held to be illegal or unenforceable neither the validity nor enforceability of the remainder of this Agreement shall be affected.

Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party. This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently supersedes all prior representations, writings, negotiations or understandings with respect hereto.

Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil commotion or industrial dispute. If such delay or failure continues for at least 30 days, the Party not affected by such delay or failure shall be entitled to terminate this Agreement by notice in writing to the other.
